These Creator Terms apply to creators, affiliates, ambassadors and partners who apply to or participate in the Smashtool Creator Program.
By applying to or participating in the program, you agree to follow these terms.
1. Program purpose
The Smashtool Creator Program is a performance-based affiliate and ambassador program.
Approved creators may promote The Original Smashtool using approved links, codes, product information and brand material provided or approved by Smashtool.
The purpose of the program is to create high-quality burger content, drive relevant traffic and generate confirmed sales through Smashtool’s official sales channels.
2. Approval
Submitting an application does not guarantee approval.
Smashtool reviews applications manually and may approve, reject, pause or remove any creator from the program at any time.
Creators may be assigned to different levels, including Affiliate, Verified Creator or Ambassador.
Creator level, commission rate, discount code, content expectations and access to brand material may vary by creator, market, campaign or separate agreement.
3. Commission
Approved creators may earn commission on confirmed sales generated through their personal affiliate link or discount code.
Commission is only payable on valid, completed and non-refunded orders.
Commission is not earned on cancelled, refunded, returned, fraudulent or self-referred orders.
Smashtool may withhold, adjust or reverse commission if an order is cancelled, refunded, returned, fraudulent, generated through unauthorized coupon sites, generated through unauthorized paid ads or otherwise violates these terms.
Commission rates may be changed, paused or updated by Smashtool at any time.
Creators are responsible for any taxes, fees or reporting obligations related to commissions or payments they receive.
4. Affiliate links and discount codes
Creators may only use affiliate links and discount codes provided or approved by Smashtool.
Creators may not publish codes on coupon sites, deal sites, browser extension platforms, discount directories or similar platforms without written approval from Smashtool.
Creators may not create fake discounts, fake scarcity, unauthorized bundles, unauthorized limited-time offers or price claims.
Creators may not claim that a discount is exclusive unless Smashtool has confirmed this in writing.
5. Brand rules
Smashtool is a premium professional kitchen tool. Creators must represent the brand accurately and professionally.
Creators may not:
- make false or misleading claims about Smashtool
- change the Smashtool name, logo or product name
- present Smashtool as a cheap gadget or discount product
- promise delivery times, warranties or results that Smashtool has not confirmed
- claim that Smashtool has approved content that has not been approved
- use Smashtool branding in paid ads without written approval
- register domains, social accounts, usernames or ads using the Smashtool name without approval
- damage the Smashtool brand through misleading, offensive, unsafe or low-quality promotion
6. Approved product claims
Creators may describe The Original Smashtool as:
- engineered in Sweden
- made from solid stainless steel
- a professional burger press
- designed for smash burgers
- built for consistency, speed and control
- designed for chefs, restaurants, food trucks, burger creators and serious food operators
- built for high-volume kitchen use
Creators may also refer to the product specifications published by Smashtool, including weight, dimensions, material and recommended patty size.
Creators may not make unapproved claims about medical benefits, guaranteed business results, guaranteed sales increases, guaranteed cooking results or comparisons that cannot be proven.
7. Advertising disclosure
Creators must clearly disclose paid, gifted, sponsored, affiliate or commission-based content when required by law, platform rules or local advertising standards.
Disclosure must be clear, visible and easy to understand.
Examples may include “ad”, “sponsored”, “paid partnership”, “affiliate link”, “gifted product” or equivalent local-language disclosure.
Creators are responsible for following the advertising and disclosure rules that apply in their country and on each platform.
8. Content usage rights
Creators own their original content unless otherwise agreed.
By tagging Smashtool, mentioning Smashtool, using a Smashtool affiliate link or discount code, submitting content to Smashtool, receiving a gifted product from Smashtool, or creating content as part of the Smashtool Creator Program, the creator gives Smashtool a worldwide, royalty-free, non-exclusive right to repost, share, edit, crop, translate, display and use the content organically on Smashtool’s owned channels.
Owned channels may include Smashtool’s social media accounts, website, Shopify store, email marketing, newsletters, sales material, retailer presentations, Amazon listings, internal content bank and other Smashtool-owned brand channels.
This organic usage right applies without additional payment unless otherwise agreed in writing.
Smashtool may make reasonable edits to the content, including cropping, resizing, subtitles, formatting, captions, translations and platform-specific adjustments, as long as the creator is not misrepresented.
Paid advertising usage, whitelisting, Spark Ads, Meta Partnership Ads, paid creator licensing or extended commercial advertising usage requires separate written approval unless already agreed in writing.
9. Product samples and gifted products
Smashtool may choose to send product samples or gifted products to selected creators.
Receiving a product sample does not guarantee approval, continued participation, fixed payment or future collaboration.
If a creator receives a gifted product, the creator must disclose this when required by law, platform rules or local advertising standards.
10. Paid advertising
Creators may not run paid ads using the Smashtool name, logo, product images, website, affiliate links, discount codes or product claims without written approval from Smashtool.
Creators may not bid on Smashtool branded keywords or create ads that appear to come directly from Smashtool.
Creators may not create landing pages, stores or sales pages that make customers believe they are operated by Smashtool.
11. Prohibited activity
Creators may not:
- generate fake orders
- self-refer purchases without approval
- use fake traffic, bots or automated engagement
- spam comments, groups, forums, direct messages or emails
- use misleading claims, fake scarcity or fake reviews
- publish codes on unauthorized coupon or deal sites
- impersonate Smashtool
- use Smashtool content in unsafe, illegal, offensive or misleading contexts
- damage the Smashtool brand
12. Returns, refunds and cancelled orders
If a customer cancels, returns or refunds an order, any related commission may be cancelled, withheld or reversed.
Smashtool may delay commission approval to account for refunds, returns, fraud checks and order validation.
13. No employment or agency relationship
Participation in the Smashtool Creator Program does not create an employment, agency, franchise, joint venture or partnership relationship between the creator and Smashtool.
Creators act independently and are responsible for their own content, taxes, equipment, channels and legal obligations.
Creators may not represent that they are employees, official representatives or legal agents of Smashtool unless agreed in writing.
14. Termination
Smashtool may pause, remove or terminate a creator’s access to the program at any time if the creator violates these terms, damages the brand, generates low-quality traffic, uses unauthorized promotion methods or no longer fits the program.
After termination, the creator must stop using Smashtool links, codes, brand material, product claims and program material unless otherwise approved in writing.
15. Changes to the program
Smashtool may update commission rates, creator levels, program rules, approved claims, content usage rules and these terms at any time.
Continued participation in the program means the creator accepts the updated terms.
16. Governing law
These terms are governed by Swedish law, unless mandatory local laws or platform rules apply.
Creators are responsible for following the laws, advertising rules and tax rules that apply in their own country and on the platforms they use.
